Important — please read carefully. By using the Cholo Sathi website, mobile applications, or related services (collectively, the "Platform"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree, please do not use the Platform.

1. About Cholo Sathi

Cholo Sathi is a technology marketplace operated in India. The Platform helps independent driver-partners and vehicle owners connect with riders, businesses, and goods-movers who are looking for transport services.

Cholo Sathi is not a transport service provider, fleet operator, or aggregator under the Motor Vehicles Aggregator Guidelines. We do not own, operate, or dispatch vehicles, do not set fares, do not receive payment for trips, and are not a party to any transport contract between users. The Platform facilitates discovery and direct contact; the transport service itself is provided by the independent driver-partner to the rider under a contract directly between them.

2. Eligibility

You must be at least 18 years old to register as a user.
Driver-partners must hold a valid driving licence, vehicle registration, insurance, and any permits required by applicable law.
You must provide accurate and current information during registration and keep it updated.

3. Account registration

You may register using your mobile phone number (verified by OTP) and/or Google sign-in. You are responsible for safeguarding your account credentials and for all activity under your account. Notify us immediately of any unauthorised use.

4. The marketplace relationship

4.1 Riders and goods-movers

When you contact a driver-partner through the Platform (via WhatsApp, call, or other channels we surface), you are entering into a direct arrangement with that driver-partner. Cholo Sathi does not negotiate, set, collect, or guarantee fares, timings, or service quality. You should verify driver-partner details and agree on terms before commencing any trip.

4.2 Driver-partners

Driver-partners use the Platform to list routes, receive matched leads, and present their services to potential riders. Driver-partners are independent contractors and are not employees, agents, or partners of Cholo Sathi. Driver-partners are solely responsible for the trips they undertake, including compliance with motor vehicle laws, taxation, and any commercial permits required.

5. Verification

Cholo Sathi performs reasonable verification of driver-partner documents (driving licence, vehicle registration, etc.). Verification is conducted on a best-effort basis and does not constitute a guarantee of identity, competence, safety, or fitness. Users should exercise their own judgement.

6. Subscriptions and payments

Driver-partners may subscribe to paid plans for enhanced visibility, leads, or other features. Subscription fees are payable to Cholo Sathi and are separate from any fare paid by a rider to a driver-partner. Subscription fees are non-refundable unless required by law or stated otherwise at the point of purchase. Refund and cancellation terms for subscriptions are published in-app.

Cholo Sathi does not process trip fares. Any payment for a transport service is settled directly between the rider and the driver-partner.

7. User responsibilities

Provide accurate information and act in good faith.
Comply with all applicable laws, including traffic, motor-vehicle, and tax laws.
Treat other users respectfully. Harassment, abuse, fraud, or unsafe behaviour will result in account suspension.
Not use the Platform to solicit business outside of it, scrape data, or interfere with its operation.

8. Reviews and ratings

Riders can leave a public star rating (1–5) and an optional comment on a driver-partner's profile. By posting a review, you agree to the following:

Reviews are public. Your display name, rating, comment, and date are visible to anyone viewing that driver-partner's profile.
Honesty. Reviews must reflect your genuine, first-hand experience. Fake reviews, paid reviews, and self-reviews are prohibited.
Acceptable content. No offensive language, threats, discriminatory remarks, personal attacks, sexual content, or personal information about anyone (phone numbers, addresses, ID numbers). Cholo Sathi runs an automated profanity filter; submissions matching it are rejected.
Off-platform solicitation. Reviews may not be used to advertise other services, post promotional codes, or direct readers to contact the driver outside the Platform.
One review per driver. You may post one review per driver-partner. You may edit or delete your review at any time.
Driver-partner reports. Driver-partners may flag reviews they consider unfair (offensive, fake, leaking personal information, spam). When enough drivers flag the same review, it is temporarily hidden pending admin review.
Moderation. Cholo Sathi may hide, edit metadata on, or remove any review that violates these Terms or any applicable law, at our discretion and without prior notice. Repeat violations may result in account suspension.
Licence. By posting a review you grant Cholo Sathi a non-exclusive, royalty-free, worldwide licence to display, store, and distribute the review in connection with the Platform.

Driver-partners cannot review riders. The review relationship is intentionally one-way.

9. Prohibited uses

You must not use the Platform to:

Transport prohibited or illegal goods, substances, or persons.
Impersonate another person or misrepresent your identity, vehicle, or documents.
Operate a competing aggregator or commercial fleet service through the Platform without authorisation.
Upload malicious code, attempt unauthorised access, or otherwise harm the Platform.

10. Intellectual property

The Cholo Sathi name, logo, software, content, and design are owned by us or our licensors and are protected by intellectual property laws. You may not copy, modify, redistribute, or create derivative works without our written permission.

11. Disclaimer of warranties

The Platform is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, Cholo Sathi disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Platform will be uninterrupted, error-free, or that any defects will be corrected.

12. Limitation of liability

Because Cholo Sathi is a marketplace and not a party to any transport contract, we are not liable for the acts or omissions of driver-partners, riders, or other users — including but not limited to delays, accidents, injuries, loss or damage to goods, missed pickups, or disputes over fare or service quality. To the maximum extent permitted by law, our aggregate liability arising out of or relating to the Platform shall not exceed the subscription fees paid by you to Cholo Sathi in the twelve (12) months immediately preceding the event giving rise to the claim.

13. Indemnification

You agree to indemnify and hold harmless Cholo Sathi, its directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Platform, your breach of these Terms, or your violation of any law or the rights of a third party.

14. Termination

You may stop using the Platform at any time. We may suspend or terminate your account if we reasonably believe you have violated these Terms, engaged in fraudulent or unsafe conduct, or if required by law. Provisions that by their nature should survive termination (intellectual property, disclaimers, limitation of liability, indemnification, governing law) will survive.

15. Changes to these Terms

We may revise these Terms from time to time. When we do, we will update the "Last updated" date above and, where the changes are material, take reasonable steps to notify you (in-app, by email, or otherwise). Your continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.

16. Governing law and dispute resolution

These Terms are governed by the laws of India. Subject to applicable law, the courts at Kolkata, West Bengal shall have exclusive jurisdiction over any dispute arising out of or in connection with the Platform or these Terms. Nothing in this clause limits any non-waivable consumer rights you may have under Indian law.
